Eligibility of Membership:

In order to eligible for membership or to use our services you must be of 18 years of age and legally able to perform binding contract. We can not accept membership for those under the age of 18 due to legal concern and potential security concerns with posting contact information for minors.

Copy and Materials:

ATVStore.ca reserves the right to monitor and not place or modify ads or pictures that may be offensive. All ads posted become the property of the publisher (this site) and may not be reproduced by a third party in other publications. By placing an add you indicate that you are the lawful owner of the material being posted and are able to transfer rights to that material over to the publisher.

Errors:

We do not take responsibility for any misplaced or incorrect ads or any financial damages that may occur from such misplaced or incorrect ads. Publisher's liability for damages resulting from publisher's failure to publish any material to which it has agreed to publish will be limited to the amount actually paid for the publication. Publisher shall not be responsible for any special, incidental or consequential damages suffered by any party resulting from its errors or omissions.

Hold Harmless:

Advertiser accepts all liability for the content of all advertising supplied by it. Advertiser warrants that all items are real and accurately described. Advertiser warrants to Publisher that its copy is true, that it is not libelous or defamatory, that it violates no rights of privacy, that it infringes no trademark, and that it complies with all applicable federal, state, and local laws and regulations. Advertiser agrees to defend, indemnify and hold harmless Publisher from any and all claims, demands, liabilities, suits, costs, or expenses, arising by reason of the publication of Advertiser's advertisement or breach of the foregoing warranty, whether such claims are well-grounded or not.

Inability to Perform:

Neither party shall be required to perform service or term where subjected to cause not reasonably in control of the performing party. This includes but not limited to inability to perform due to acts of god, labor restrictions, strikes, lockouts, government authority, civil riot, floods, fire or other disasters.

Warranty:

We provide our website on an 'as-is' condition. We will not be held liable for any damages resulting from the use of our site or its classified ads.

Privacy:

We do not disclose personal information without your permission.

Selling:

As a user you may sell merchandise on this site. Our restriction on the items you may sell limits the sale to ATV, off-road and recreational vehicles only. You may not sell illegal merchandise, pornography or any other inappropriate material. All classified advertisements must not contain pornographic material, profanity or offensive or racial remarks.
